Marcellus Shale and Real Estate
David A. Borkovic
Mr. Borkovic, who practices in the areas of business litigation, construction, and Marcellus Shale, has successfully prosecuted and defended hundreds of millions of dollars of commercial and corporate lawsuits throughout the United States. Most of Mr. Borkovic’s current practice is devoted to representing landowners in Marcellus Shale and gas lease disputes. He successfully recovered roughly $14 million from Rex Energy for landowners in Westmoreland County, PA; has represented landowners in class actions against Halcon Energy Properties, and against XTO Energy; and has prosecuted landowners’ claims against EQT, Range Resources, Chief Exploration, and others.
Before joining Jones, Gregg, Mr. Borkovic was associated with a boutique commercial litigation firm that had spun-off from Kirpatrick & Lockhart (currently K&L Gates). He was a partner and spent nearly twenty years at Kirkpatrick & Lockhart. Mr. Borkovic served for two years as a law clerk to the Hon. Joseph F. Weis, Jr., of the United States Court of Appeals for the Third Circuit.
Mr. Borkovic has been recognized by other lawyers as a Super Lawyer and has a Martindale-Hubbard lawyer rating of “AV Preeminent,” the highest possible rating. He has been appointed an adjunct professor at Duquesne University School of Law, where he teaches Complex Litigation and Class Actions, as well as the advanced course in the Federal Rules of Civil Procedure.
Mr. Borkovic received his Juris Doctorate with honors from Duquesne University in 1975. He received a B.S. in Mathematics and a Master of Science in Physics from Carnegie Mellon University.
He is admitted to practice before the United States Supreme Court, the United States Courts of Appeals for the Third and Fifth Circuits, the United States Court of Appeals for the District of Columbia Circuit, the United States District Court for the Western District of Pennsylvania, and the Supreme Court of Pennsylvania.
